Terms of Service — Anchor Events

1. Acceptance of These Terms

By accessing or using anchorevents.live (the “Site”), operated by Anchor Merchandising, a sole proprietorship, of which Anchor Events is a project (“Anchor Events,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Site.

We may update these Terms at any time. Continued use of the Site after changes are posted means you accept the revised Terms. See Section 15.

2. What Anchor Events Does

Anchor Events is a live event discovery and ticketing platform. We:

  • List concerts, festivals, and other events submitted by promoters, venues, bands, and organizers (“Organizers”), as well as events we curate ourselves.
  • Allow visitors to browse and search for events by location, artist, and category.
  • Facilitate ticket sales for certain events directly through the Site (via WooCommerce).
  • For events where the Organizer supplies their own ticket link, we simply link out to that third-party ticketing provider — we have no control over and no responsibility for that transaction.

3. Accounts

  • When you submit an event through the Site, we automatically create a user account for you (or link the submission to your existing account if you’re already logged in, or if the email you provide matches an existing account).
  • You’re responsible for keeping your account credentials secure and for all activity under your account.
  • You represent that any information you provide (name, email, phone, event details) is accurate and that you have the right to submit it.

4. Event Submissions & User Content

  • You own your content. By submitting an event (including any text, images, or other materials), you retain ownership, but you grant Anchor Events a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute that content on the Site and in related promotional materials (e.g. the homepage slider, social media, email digests) for as long as the event listing remains active or as reasonably needed afterward for historical/archival display.
  • You’re responsible for accuracy. Submitted events publish to the Site automatically, without our review before they go live. You are solely responsible for the accuracy of everything you submit — dates, times, venue information, pricing, and artist lineups.
  • Prohibited content. You may not submit events that are fraudulent, illegal, infringe on someone else’s rights (including using a venue, artist name, or image without permission), or that promote hate speech, violence, or discrimination.
  • We reserve the right to remove, edit, or unpublish any submitted event at any time, for any reason, without notice.

5. Ticket Sales & Payments

  • For events marked “Sell tickets through Anchor Events,” we act as an intermediary: tickets are sold through the Site via WooCommerce, and Anchor Events collects payment from ticket buyers on the Organizer’s behalf.
  • Prices, fees, and any taxes are set by the Organizer at the time of submission; buyers should review event details carefully before purchasing.
  • Anchor Events adds a service fee to the ticket price at checkout, charged to the buyer. See Section 7 for how this fee relates to Organizer payouts. The service fee is non-refundable except when an event is fully cancelled (not merely postponed or rescheduled), in which case the service fee will be refunded along with the ticket price.
  • For events with the Organizer’s own ticket link, that transaction happens entirely outside the Site, on the third-party platform’s own terms — Anchor Events is not a party to that transaction and bears no responsibility for it.

6. Refunds & Cancellations

All refund and cancellation decisions are made solely at the discretion of the venue and/or event Organizer. Anchor Events does not independently guarantee, process, or override refund decisions. If an event is cancelled, postponed, or changed, ticket buyers should contact the Organizer or venue directly using the contact information on the event listing. Anchor Events will make reasonable efforts to facilitate communication but is not obligated to issue refunds itself.

The one exception is Anchor Events’ own service fee (see Section 5): if an event is fully cancelled, Anchor Merchandising will refund its service fee along with whatever ticket price refund the Organizer issues. The service fee is not refunded for postponements, reschedulings, or any other circumstance.

7. Payouts to Organizers

  • Organizers selling tickets through Anchor Events choose a payout method (PayPal, Venmo, or CashApp) and provide a username/handle at the time of submission.
  • Payouts are issued within 5 business days after the event.
  • PayPal transactions may be subject to PayPal’s own fees, which may be deducted from the payout amount.
  • Anchor Events is not responsible for payout errors caused by an Organizer providing an incorrect or outdated username/handle.
  • Anchor Events charges a service fee on ticket sales, added to the ticket price and paid by the ticket buyer at checkout. This fee is separate from the ticket price the Organizer sets and does not reduce the Organizer’s payout.
  • The Organizer receives 100% of the gross ticket price they set, subject only to any fees charged by the digital payment platform used for payout (e.g., PayPal fees).

8. Homepage Slider Feature (Paid Add-On)

  • Organizers may pay an additional fee (currently $20, subject to change) to feature their event in the rotating homepage slider.
  • This is a promotional placement only. Anchor Events does not guarantee any specific number of views, clicks, ticket sales, or other results from slider placement.
  • Featured placement rotates automatically alongside other featured/hand-picked events and is not guaranteed to appear continuously or in any particular position.
  • The Homepage Slider Feature add-on is non-refundable once purchased, regardless of event cancellation, postponement, or performance of the slider placement itself.
  • An event image must be provided at the time of submission in order to be eligible for slider placement.

9. Prohibited Uses

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms.
  • Submit false, misleading, or fraudulent event listings.
  • Attempt to interfere with, disrupt, or gain unauthorized access to the Site, its servers, or connected systems.
  • Scrape, harvest, or collect data from the Site using automated means without our prior written consent.
  • Impersonate any person or entity, or misrepresent your affiliation with a venue, artist, or organization.
  • Use the Site to harass, defraud, or harm any other user, Organizer, or ticket buyer.

10. Third-Party Services

The Site uses or links to third-party services, including but not limited to WooCommerce (payment processing), SmartForms (form handling), OpenStreetMap/Nominatim (location data), and various ticketing platforms linked from Organizer-submitted events (e.g. Eventbrite, Bandsintown). We are not responsible for the content, policies, or practices of any third-party service. Your use of those services is governed by their own terms.

11. Intellectual Property

The Site’s design, logo, “Anchor Events” branding, and original content (excluding user-submitted event content, which remains owned by the submitter per Section 4) are the property of Anchor Events and may not be copied, reproduced, or used without our written permission.

12. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY EVENT LISTING, SINCE MOST CONTENT IS SUBMITTED BY THIRD PARTIES WITHOUT OUR REVIEW.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ANCHOR EVENTS AND ITS OWNERS, OFFICERS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, GOODWILL, USE, OR DATA, ARISING FROM YOUR USE OF THE SITE, INCLUDING BUT NOT LIMITED TO EVENT CANCELLATIONS, TICKETING ERRORS, PAYOUT DELAYS, OR INACCURATE EVENT INFORMATION SUBMITTED BY THIRD PARTIES — REGARDLESS OF THE LEGAL THEORY ASSERTED, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED THE AMOUNT YOU PAID TO ANCHOR EVENTS (IF ANY) IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In that case, our liability is limited to the maximum extent permitted by law.

[This follows the general structure common among comparable platforms (e.g. Eventbrite): damages exclusions plus a liability cap tied to fees paid, with a savings clause for jurisdictions that restrict such limitations. An attorney may still recommend adjusting or expanding this section based on your specific risk exposure, particularly around ticket sale disputes.]

14. Indemnification

You agree to indemnify and hold harmless Anchor Events from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from: (a) your submitted content, (b) your violation of these Terms, or (c) your violation of any law or the rights of a third party.

15. Changes to These Terms

We may revise these Terms at any time by posting an updated version on this page. Material changes will update the “Last Updated” date above. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

16. Termination

We may suspend or terminate your account or access to the Site at any time, for any reason, including violation of these Terms, without prior notice.

17. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict of law principles.

Binding Arbitration & Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or your use of it (a “Dispute”) will be resolved by binding individual arbitration, rather than in court, except that either party may bring an individual action in small claims court if the claim qualifies.

  • Individual basis only. You and Anchor Events each agree that any arbitration will be conducted on an individual basis only, not as a class, consolidated, or representative action. You and Anchor Events each waive any right to a jury trial and to participate in a class action.
  • Arbitration provider. Arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect. Information about the AAA and its rules is available at adr.org.
  • Location. Arbitration will take place in Rutherford County, Tennessee [confirm this is the right county for your business address], unless you and Anchor Events agree otherwise, or unless the arbitration rules require a different location for claims of this size.
  • Carve-outs. Nothing in this section prevents either party from: (a) bringing an individual claim in small claims court, (b) seeking injunctive or other equitable relief to protect intellectual property rights, or (c) Anchor Events pursuing collection of unpaid amounts owed to it through the courts rather than arbitration.
  • Opt-out. You may opt out of this arbitration agreement by emailing anchorevents77@gmail.com within 30 days of first agreeing to these Terms, stating clearly that you wish to opt out of arbitration. If you opt out, disputes will instead be resolved in the state or federal courts located in Rutherford County, Tennessee, as described above.
